My neighbour’s tree overhangs my property. What are my rights?
Queensland’s Neighbourhood Disputes (Dividing Fences and Trees) Act 2011 sets out a process. You can generally cut back overhanging branches to the boundary at your own cost, or serve a formal notice on the tree keeper. If that fails, QCAT can make orders. An independent report is what turns a disagreement into a documented position.
Do I need an arborist report for QCAT?
Not strictly, but tree matters turn on arboricultural facts — whether a tree is likely to cause serious injury or damage, and what a reasonable remedy is. An independent expert report addressing those points directly is materially stronger than an assertion.
Will you take my side?
No — and that is what makes the report useful. An expert report is only persuasive if it is independent. You get an honest assessment, including when it does not support the position you were hoping for. Better to know before you spend money on a hearing.
